Preliminary provisions
The online store Inventia Sklep available at the internet address https://inventiasklep.pl/ is operated by INVENTIA TECHNOLOGIES SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office at Leśna 11, 83-041 Żuławka, entered into the National Court Register by the DISTRICT COURT GDAŃSK-PÓŁNOC, VII ECONOMIC DEPARTMENT OF THE NATIONAL COURT REGISTER under the KRS number 0000983002, NIP: 6040232180, REGON: 522624156.
This Regulations is addressed to both Consumers and Entrepreneurs using the Store. It specifies the rules for using the online Store and the rules and procedure for concluding distance sales contracts with the Customer through the Store.
§ 2
Definitions
Consumer - a natural person entering into an agreement with the Seller within the Store, the subject of which is not directly related to its business or professional activity.
Seller - Inventia Sklep online store run by INVENTIA TECHNOLOGIES SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ with its registered office at Leśna 11, 83-041 Żuławka, entered into the National Court Register by the DISTRICT COURT GDAŃSK-PÓŁNOC, VII ECONOMIC DEPARTMENT OF THE NATIONAL COURT REGISTER under the KRS number 0000983002, NIP: 6040232180, REGON: 522624156.
Client - any entity making purchases through the Store.
Entrepreneur - a natural person, legal person and organizational unit not being a legal person, which is granted legal capacity by a separate act, conducting business on its own behalf, which uses the Store.
Store - an online store run by the Seller at https://inventiasklep.pl/
Distance contract - a contract concluded with the Customer as part of an organized system of concluding contracts at a distance (within the Store), without the simultaneous physical presence of the parties, exclusively through the use of one or more means of distance communication until the conclusion of the contract.
Regulations - these Store regulations.
Order - an action, Customer's declaration of intent aimed directly at concluding a Sales Agreement for the Product with the Seller and performing the service on behalf of the Customer, on the terms specified in these Regulations.
Order form - an interactive form available in the Store enabling placing an Order, in particular by adding Products to the Cart and specifying the terms of the Sales Agreement, including the method of delivery and payment.
Consumer Rights Act - the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827, as amended).
Civil Code - the Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended).

§ 4
Technical requirements
To use the Store, including viewing the assortment of the Store and placing orders for Products, you need:
terminal device with Internet access and a web browser that supports cookies, eg Internet Explorer, Chrome, Safari, Firefox;
an active e-mail account (e-mail);
enabled cookies files;
Flash Player installed (recommended).
§ 5
General information
Seller, to the fullest extent permitted by law, shall not be liable for disruptions, including interruptions in the functioning of the Store caused by force majeure, unauthorized actions of third parties or incompatibility of the online Store with the technical infrastructure of the Customer.
Using the Store is possible provided that the ICT system used by the Customer meets the following minimum technical requirements: terminal device with Internet access and a web browser that supports cookies, an active e-mail account (e-mail), enabled cookies files, Flash Player installed (recommended).
Customers should use the Store in a manner consistent with the law and good manners, with respect for personal rights and intellectual property rights of third parties.
The Seller declares that the public nature of the Internet and the use of electronic services may pose a risk of obtaining and modifying Customers' data by unauthorized persons, therefore Customers should use appropriate technical measures to minimize the above-mentioned risks. In particular, they should use anti-virus programs and protect the identification data of the Customer.
All names and trademarks of Products available in the Store are used for identification purposes and may be protected under the Act on Industrial Property Rights of 30 June 2000. All rights to the mentioned trademarks are reserved for their owners.
§ 6
Procedure for concluding a Sales Agreement
In order to conclude a Sales Agreement via the Store, go to the website https://inventiasklep.pl/ select the Product being the subject of the Order, take further technical steps based on the messages displayed to the Customer and information available on the website.
Selection of ordered Products by the Customer is made by adding them to the basket.
When placing an Order - until the "Order Confirmation" button is pressed - the Customer has the possibility to modify the entered data and the selected Product. To do this, follow the messages displayed to the Customer and the information available on the website.
After providing the Customer with all the necessary data, a summary of the placed Order will be displayed. The summary of the placed Order will include information regarding: the subject of the Order, the unit and total price of the ordered Products or services, the chosen method of delivery, the chosen method of payment, and delivery time.
In order to send an Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory and press the "Order Confirmation" button.
Information about the Products provided on the Store's website constitutes an invitation to conclude a contract within the meaning of art. 71 of the Civil Code.
After placing the Order, the Customer receives an e-mail with confirmation of all essential elements of the Order.
The contract is considered concluded when the Customer receives an e-mail referred to above.
§ 7
Delivery
The delivery of Products is limited to the territory of the Republic of Poland and takes place at the address indicated by the Customer when placing the Order.
Delivery of ordered goods is carried out via courier.
Delivery time is up to 7 business days, unless a different delivery date is given in the description of the Product or when placing the Order.
The beginning of the delivery of the Product to the Customer counts as follows:
if the Customer chooses the method of payment by bank transfer, electronic payment or payment by credit card - from the date of crediting the Seller's bank account or settlement account,
in the case of payment upon delivery - from the date of the Sales Agreement.
§ 8
Prices and payment methods
The prices given on the Store's website are given in Polish zlotys and are gross prices (including VAT).
The Customer can pay the price:
by bank transfer to the Seller's account,
by electronic payment,
cash on delivery upon receipt of the Product,
via online payment system.
The customer chooses the method of payment when placing the Order.
If the Customer chooses to pay by bank transfer, electronic payment or payment by credit card, the customer is obliged to make the payment within 7 calendar days from the date of the Sales Agreement.
§ 9
Right to withdraw from the contract
The consumer has the right to withdraw from the contract concluded at a distance, without giving reasons, by submitting an appropriate statement in writing within 14 days from the date of delivery of the Product. To meet this deadline, it is enough to send a statement before its expiry to the Seller's address or e-mail address.
The statement may be submitted on a withdrawal form, which is an attachment to these Regulations, but it is not obligatory.
In the event of withdrawal from the contract, the contract is considered null and void.
If the consumer submits a statement of withdrawal from the contract before the Seller accepts his offer, the offer ceases to be binding.
The Seller is obliged to immediately, not later than within 14 days from the date of receipt of the consumer's statement on withdrawal from the contract, return to the consumer all payments made by him, including the costs of delivery of the goods. The seller may withhold the reimbursement of payments received from the consumer until he has received the goods back or the consumer has provided proof of sending them back, depending on which event occurs first.
The consumer is obliged to return the goods to the Seller immediately, not later than within 14 days from the date on which he withdrew from the contract. To meet the deadline, it is enough to return the item before its expiry to the Seller's address.
The consumer bears the direct costs of returning the goods.
The consumer is responsible for reducing the value of the goods resulting from using it in a way that goes beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
The consumer does not have the right to withdraw from the contract concluded at a distance in relation to contracts:
for the provision of services, if the Seller has fully provided the service with the express consent of the consumer who was informed before the provision that after the performance of the service by the Seller, he will lose the right to withdraw from the contract;
in which the price or remuneration depends on fluctuations in the financial market over which the Seller has no control, and which may occur before the deadline to withdraw from the contract;
in which the subject of the service is a non-prefabricated item, manufactured according to the consumer's specification or serving to satisfy his individual needs;
in which the subject of the service is an item that deteriorates quickly or has a short shelf-life;
in which the subject of the service is an item delivered in a sealed package, which after opening the package cannot be returned due to health protection or hygiene reasons, if the packaging has been opened after delivery;
in which the subject of the service are items that after delivery, due to their nature, are inseparably connected with other items;
in which the subject of the service are alcoholic beverages, the price of which was agreed at the conclusion of the Sales Agreement, and the delivery of which can take place only after 30 days and the value of which depends on fluctuations in the market over which the Seller has no control;
in which the consumer expressly demanded that the Seller come to him for urgent repair or maintenance; if the Seller provides additional services other than those demanded by the consumer or supplies items other than spare parts necessary to perform the repair or maintenance, the right to withdraw from the contract is entitled to the consumer in respect of additional services or items;
in which the subject of the service are sound or visual recordings or computer programs delivered in a sealed package, if the package has been opened after delivery;
for delivering newspapers, periodicals or magazines, with the exception of a subscription agreement;
concluded through a public auction;
for the provision of accommodation services other than for residential purposes, transport of goods, car rental, catering, services related to leisure, entertainment, sports or cultural events, if the contract indicates the day or period of service provision;
for the provision of digital content that is not saved on a tangible medium, if the performance began with the consumer's express consent before the deadline to withdraw from the contract and after informing the Seller about the loss of the right to withdraw from the contract.
§ 10
Complaints about the Product
The basis and scope of the Seller's liability towards the Customer, if the Product sold has a physical or legal defect (warranty), are defined by generally applicable laws, in particular in the Civil Code (in particular, articles 556-576 of the Civil Code).
Complaints can be made in writing to the address of the Seller's registered office or by e-mail to the address kontakt@inventiasklep.pl.
It is recommended that the complaint include a brief description of the defect, circumstances (including the date) of its occurrence, the name and surname of the complainant, contact details of the complainant and the Customer's request in connection with the defect of the goods.
Consideration of the complaint by the Seller will take place immediately, no later than within 14 days from the date of its submission. Lack of response from the Seller within 14 days means that the Seller considered the complaint justified.
§ 11
Complaints and Warranty
The Sales Agreement covers new products.
The Seller is obliged to deliver goods free from defects to the Customer.
In the event of a defect in the goods purchased from the Seller, the Customer has the right to make a complaint based on the provisions regarding warranty in the Civil Code. An entrepreneur acting as a natural person may have rights under the warranty if the lack of connection of the transaction with the conducted business activity is demonstrated, and thus acquired consumer rights. In relation to such persons, the provisions regulating consumer rights related to warranty will apply.
The complaint should be reported electronically to the email address: sklep@inventia.sklep.pl, attaching the Complaint Form.
The product should be returned to the Store's address: Leśna 11, 83-041 Żuławka. It is recommended to include in the complaint a concise description of the defect, circumstances (including the date) of its occurrence, data of the Customer submitting the complaint, and the Customer's request regarding the defect of the Product.
The Seller will respond to the complaint request immediately, no later than within 14 days from receiving the return, and if it does not do so within this period, it will be considered that the Customer's request has been acknowledged as justified.
§ 12
Out-of-court Complaints Handling and Claims
Detailed information regarding the possibility for the Consumer to use out-of-court methods of complaint handling and claims enforcement, as well as the rules for access to these procedures, is available at the offices and websites of district (urban) consumer advocates, social organizations whose statutory tasks include consumer protection, Voivodship Trade Inspection Inspectorates, and at the following internet addresses of the Office of Competition and Consumer Protection:

The Consumer has the following examples of options to use out-of-court methods of complaint handling and claims enforcement:
The Consumer is entitled to refer to the permanent consumer arbitration court referred to in art. 37 of the Act of 15 December 2000 on Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request for resolution of a dispute arising from the Agreement concluded with the Seller.
The Consumer is entitled to refer to the voivodeship inspector of the Trade Inspection, in accordance with art. 36 of the Act of 15 December 2000 on Trade Inspection (Journal of Laws of 2014, item 148, as amended), with a request to initiate mediation proceedings for amicable settlement of a dispute between the Consumer and the Seller.
The Consumer may obtain free assistance in resolving a dispute between him and the Seller, also using the free assistance of the district (urban) consumer advocate or social organization whose statutory tasks include consumer protection (including the Consumer Federation, Polish Consumers' Association).
§ 13
Personal Data in the Online Store
The Seller is the administrator of personal data of Customers collected through the Online Store.
Personal data of Customers collected by the administrator through the Online Store are collected for the purpose of fulfilling the Sales Agreement, and if the Customer agrees - also for marketing purposes -newsletter.
The recipients of personal data of Customers of the Online Store may be:
In the case of a Customer who uses courier delivery or parcel machines, etc. in the Online Store:
The administrator provides the collected personal data of the Customer to the selected carrier or intermediary delivering shipments on behalf of the Administrator.
In the case of a Customer who uses electronic payments or a payment card in the Online Store:
The administrator provides the collected personal data of the Customer to the selected entity servicing the above payments in the Online Store.
The Customer has the right to access and correct their data.
Providing personal data is voluntary, however, failure to provide the personal data indicated in the Regulations necessary to conclude the Sales Agreement results in the inability to conclude this Agreement.
Providing false personal data, in particular a non-existent email address, will result in deletion of the placed order and blocking of the account.
Providing personal data belonging to another person will be treated as impersonation with legal consequences (Article 190a § 2 of the Criminal Code).
§ 14
Final Provisions
Agreements concluded through the Online Store are concluded in Polish.
The Seller reserves the right to amend the Regulations for valid reasons, i.e., changes in the law, changes in payment and delivery methods - to the extent to which these changes affect the implementation of the provisions of these Regulations. The Seller will inform the Customer about each change at least 7 days in advance.
Matters not regulated in these Regulations are subject to the generally applicable provisions of Polish law, in particular: the Civil Code; the Act on the provision of electronic services; the Consumer Rights Act, the Personal Data Protection Act.
The Customer has the right to use out-of-court methods of complaint handling and claims enforcement. To this end, he may lodge a complaint through the EU ODR online platform available at: http://ec.europa.eu/consumers/odr/.
